2.4 Nothing in this Agreement grants any right, license or interest with respect to the source code of the Software. This Agreement sets forth the entire agreement and understanding of the parties with respect to the subject matter of this Agreement and summarizes all prior discussions and agreements on the matter between them. “Maintenance Agreement” means a support and maintenance agreement separate from Ekahau Site Survey entered into or capable of being entered into between Ekahau and you. (ii) Licensee enters into agreements with such subcontractors that require such subcontractors to comply with the terms that provide Ekahau with protection equivalent to those set forth in Sections 2.2, 6 and 10 (but without the right to disclose Confidential Information to any party other than Licensee) of this Agreement, and any breach of these Terms by such subcontractor shall be considered a breach by Licensee of this Agreement. Except as expressly stated or modified in an agreement signed between Ekahau and you, this Agreement constitutes the entire agreement between the parties with respect to the license or subscription to the Software and supersedes any conflicting or additional terms contained in a purchase order or elsewhere, all of which are excluded.

If any part of this Agreement is held to be void or unenforceable, the remaining provisions of this Agreement shall remain in full force and effect. People who purchase a license of Survey software apply the license to a wireless USB dongle and share the dongle with other engineers or surveyors.
For many years, we have been using all these types of tools in the same way. 6.1 Licensee understands and agrees that the Ekahau Site Survey and related documentation (if any) will be licensed and delivered to Licensee “as is” in the current phase of development, without any express, implied, statutory or other warranties, including, but not limited to, warranties of fitness for a particular purpose, design, non-infringement of the rights of third parties or merchantability.
